1. Introduction

Welcome to ArchiveNeutralCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and the website at archiveneutralcommons.sbs (the "Service") which is operated by ArchiveNeutralCommons.

By reserving a charter or using our Service, you consent to be legally bound by these Terms. Should you not agree with any section of these terms, you are not authorized to use the Service.

2. Service Overview

ArchiveNeutralCommons offers an array of high-end yacht charter services which include:

• Yacht rentals for the day
• Evening yacht tours
• Corporate getaways
• Exclusive gatherings
• Extended charters

The provision of all services is dependent on their availability and prevailing weather conditions. We reserve the right to alter or terminate any service without prior notification.

3. Booking and Reservations

3.1 Booking Process

For booking a yacht charter, you are required to:

• Be no younger than 18 years of age
• Supply information that is both accurate and complete
• Make a deposit payment as outlined in your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is considered confirmed once we receive your payment and provide you with written affirmation. We reserve the prerogative to decline service to anyone at our sole discretion.

3.3 Availability

Charter reservations are contingent on yacht availability and favorable weather conditions. We will strive to accommodate your requested dates and times to the best of our ability.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and encompass all applicable taxes unless stated otherwise. We reserve the right to modify prices unexpectedly.

4.2 Payment Schedule

• Deposit: 50% of the full charter cost required at the time of booking
• Final Payment: Payable 48 hours before the charter sets sail
• Additional expenses (if any): Payable upon the completion of the charter

4.3 Payment Methods

We accept various forms of payment including major credit cards, electronic bank transfers, and certified bank drafts. Secure, encrypted channels are used for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If canceled more than 72 hours before departure: Full refund minus any processing fees
• Between 24 to 72 hours before departure: Refund of 50%
• Less than 24 hours before departure: Non-refundable

5.2 Weather Cancellations

In cases where our captain deems the weather conditions unsafe, we will propose to:

• Schedule your charter for the soonest available date with no extra charge
• Issue a full refund if a rescheduling is not feasible

5.3 Mechanical Issues

If a mechanical issue arises with the vessel assigned to your charter, we will strive to offer an appropriate substitute. Should a substitute not be obtainable, we will issue a full refund.

6. Safety and Conduct

6.1 Safety Regulations

All passengers are obliged to:

• Comply with instructions given by the crew
• Wear any safety gear as needed
• Disclose any medical conditions impacting their safety
• Stay within designated areas onboard the vessel

6.2 Prohibited Items

The items listed below are not allowed on board:

• Glass containers
• Illegal substances
• Firearms or any weapons
• Excessively large quantities of non-alcoholic drinks (beyond what is considered reasonable consumption)
• Pets (except with prior permission)

6.3 Behavior

Conduct on board should be considerate and respectful at all times. Any behavior that poses a safety hazard or detracts from the pleasure of others may result in the premature termination of the charter without a refund.

7. Liability and Insurance

7.1 Limitation of Our Liability

Our accountability is capped at the actual payment made for the charter. We are not responsible for:

• Injuries sustained due to the passenger's own carelessness
• Theft, loss, or damage to personal belongings
• Indirect or secondary consequences and punitive damages
• Delays due to weather or situations outside of our control

7.2 Insurance Details

We maintain comprehensive marine insurance that covers our ships and operation activities. It is your responsibility to secure personal travel and belongings insurance.

7.3 Risk Acknowledgment

By engaging in our yacht services, you recognize that maritime activities have inherent risks which you accept, thus assuming liability for your own safety and actions.

8. Alterations and Itinerary Adjustments

We retain the right to adjust itineraries, routes, or schedules in cases of adverse weather conditions, for safety reasons, or due to operational needs. We will endeavor to offer similar alternatives whenever possible.

9. Force Majeure

We do not take responsibility for any hold-ups, cancellations, or changes caused by events beyond our control such as, but not limited to:

• Extreme weather events
• Natural catastrophes
• Legislative actions
• Cessation of port operations
• Equipment malfunctions

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. By utilizing our services, you authorize us to gather and use your information according to the description in our Privacy Policy.

11. Intellectual Property

All materials on our website, including but not limited to text, graphics, logos, and images, are secured by copyright and trademark laws. You are prohibited from replicating, disseminating, or creating derivative works without our express written consent.

12. Applicable Law

The governing laws of Monaco apply to these Terms. Any legal disputes will be resolved in the courts situated in Monaco, Monaco.

13. Amendments to Terms

We have the authority to change these Terms whenever necessary. Updated versions will be posted on our website, denoted with a revised date. Your continued use of our services post-modification equates to your acceptance of the new terms.
